1. Acceptance of these Terms
By accessing or using ScrapRunnerNYC, creating an account, purchasing credits, posting a listing, accepting a pickup, responding to a text message, or otherwise using the Services, you agree to these Terms of Service and our Privacy Policy.
If you do not agree to these Terms, do not access or use the Services. If you use ScrapRunnerNYC on behalf of a business, company, contractor, crew, or other organization, you represent that you have authority to bind that organization to these Terms.
2. Eligibility
You must be at least 18 years old and legally capable of entering into a binding agreement to use ScrapRunnerNYC.
You may not use the Services if you have previously been suspended or removed from ScrapRunnerNYC, if your use would violate applicable law, or if you are prohibited from entering into this agreement.
3. ScrapRunnerNYC’s role
ScrapRunnerNYC provides technology that allows users to post information about scrap, recyclable material, removal opportunities, rubbish, equipment, or related pickup work and allows other users to view, accept, schedule, and complete those opportunities.
ScrapRunnerNYC is not the owner, seller, buyer, transporter, recycler, waste hauler, broker, employer, joint employer, general contractor, subcontractor, or agent of any user unless expressly stated in writing.
Users independently decide whether to post, accept, schedule, perform, cancel, or complete a pickup. ScrapRunnerNYC does not guarantee:
- that any listing will be accepted;
- that any user will appear at a scheduled time;
- the quantity, condition, legality, ownership, or value of material;
- the identity, licensing, insurance, skill, or conduct of any user;
- that any pickup will generate revenue or profit; or
- that any material may legally be transported, recycled, or disposed of.
4. User accounts
You must provide accurate, current, and complete information when creating and maintaining your account. You are responsible for all activity conducted through your account and phone number.
You agree to notify ScrapRunnerNYC promptly if you believe your account or phone number has been accessed without authorization.
You may not create an account using another person’s identity, phone number, business name, license, insurance information, or credentials without authorization.
Account labels, verification indicators, document reviews, or badges do not constitute a guarantee, endorsement, certification, or warranty by ScrapRunnerNYC.
5. Listings and posts
Users who create listings are responsible for ensuring that all information in the listing is truthful, accurate, lawful, and not misleading.
A listing should accurately describe:
- the type of material or work involved;
- the approximate quantity or volume;
- the pickup location;
- known access restrictions or hazards;
- whether special tools, vehicles, labor, permits, or licenses are required;
- whether the material includes rubbish, mixed waste, or regulated material; and
- any material fact that could affect the safety or legality of the pickup.
The posting user represents that they own the material, control the property, or have permission from the lawful owner or authorized party to offer the material for pickup or request its removal.
ScrapRunnerNYC may remove, restrict, reclassify, suspend, or reject a listing that appears inaccurate, unsafe, unlawful, fraudulent, duplicative, prohibited, or inconsistent with these Terms.
6. Claims, offers, scheduling, and pickups
A user who claims or accepts a pickup is responsible for evaluating the listing and determining whether they have the experience, labor, equipment, vehicle, insurance, permits, licenses, and legal authority required to perform the work.
Accepting or claiming a listing may create a direct arrangement between the posting user and the accepting user. ScrapRunnerNYC is not a party to that arrangement.
Users must provide reasonable and accurate pickup times, promptly communicate delays, mark arrival and completion honestly, and release a pickup they cannot complete.
A user may not falsely claim a pickup, hold a listing without a genuine intent to complete it, interfere with another user’s pickup, or mark a pickup complete when the work was not completed.
Users are solely responsible for agreeing on any price, payment, compensation, salvage rights, labor cost, disposal charge, or transfer of ownership that is not expressly processed through ScrapRunnerNYC.
7. ScrapRunnerNYC credits
Certain actions on ScrapRunnerNYC may require credits. Paid actions may include creating a listing, claiming or accepting a pickup, promoting a listing, sending priority notifications, or accessing other premium functionality.
The number of credits required for an action will be displayed before the action is completed or described on the applicable pricing or credits page.
Credits are a limited, revocable license to access eligible features within ScrapRunnerNYC. Credits:
- are not money or legal tender;
- have no cash value outside ScrapRunnerNYC;
- may not be redeemed for cash;
- may not be sold, transferred, or exchanged between users unless ScrapRunnerNYC expressly permits it;
- do not represent a deposit account, stored-value account, security, investment, or ownership interest; and
- may be subject to usage rules displayed at the time of purchase or use.
ScrapRunnerNYC may offer purchased credits, promotional credits, bonuses, refunds, administrative adjustments, or other credit types. Promotional or bonus credits may be subject to separate limitations.
A credit balance shown in your account may include purchased, promotional, refunded, or administratively adjusted credits.
8. Credit purchases and payment processing
Credit purchases and other payments may be processed by third-party payment processors, including Stripe. ScrapRunnerNYC does not directly store complete payment-card details.
By submitting a payment, you authorize the applicable payment processor to charge the payment method you provide for the amount shown at checkout, including any applicable taxes or fees.
You represent that you are authorized to use the payment method submitted. You are responsible for any bank charges, card fees, insufficient-funds fees, currency-conversion fees, or similar charges imposed by your financial institution.
Except where required by law or expressly stated in these Terms, completed credit purchases are final and non-refundable.
ScrapRunnerNYC may correct a credit balance or reverse credits if a payment is canceled, refunded, disputed, reversed, charged back, fraudulent, duplicated, or otherwise invalid.
If your account does not contain enough credits to cover a reversal, your balance may become restricted, your account may be suspended, or you may be required to purchase or repay credits before using paid features.
9. Cancellations, releases, and credit restoration
Credit restoration depends on the type of paid action, the status of the listing or pickup, the reason for cancellation, and the policy displayed when the credits were spent.
ScrapRunnerNYC may restore credits when:
- a paid action fails because of a confirmed technical error;
- ScrapRunnerNYC cancels or removes a listing through no fault of the user;
- a duplicate debit is confirmed;
- a posting user cancels before another user has claimed, accepted, or acted upon the listing, where the applicable policy permits restoration; or
- ScrapRunnerNYC approves a restoration in its discretion.
Credits may not be restored when:
- a listing has already produced a claim, offer acceptance, dispatch, notification, or other paid platform service;
- a user changes their mind after receiving the paid feature;
- a user voluntarily releases, abandons, misses, or fails to complete a pickup;
- a listing or account violates these Terms;
- a user misrepresented the material, location, ownership, licensing, or work required; or
- the underlying dispute is between users rather than caused by a ScrapRunnerNYC system error.
ScrapRunnerNYC may determine whether a credit restoration is warranted based on platform records, transaction history, communications, pickup status, and other available information.
10. Prohibited and regulated materials
Users may not use ScrapRunnerNYC to post, request, transport, transfer, remove, sell, purchase, or dispose of unlawful, stolen, dangerous, or prohibited material.
Prohibited materials include, without limitation:
- stolen property or property offered without lawful authorization;
- firearms, ammunition, explosives, or explosive devices;
- illegal drugs or controlled substances;
- human remains, biological material, or infectious medical waste;
- radioactive material;
- uncontained asbestos;
- hazardous chemicals, toxic substances, or hazardous waste not properly identified and handled;
- pressurized, flammable, or explosive containers that cannot lawfully be transported;
- materials whose possession, transportation, purchase, or disposal is prohibited by law; and
- any material prohibited by a separate ScrapRunnerNYC policy.
Rubbish, trash, mixed waste, construction debris, commercial waste, and other regulated material may require a licensed or authorized waste hauler. Users are responsible for identifying and complying with those requirements.
11. Licenses, permits, insurance, and legal compliance
Each user is solely responsible for determining and maintaining all licenses, permits, registrations, insurance, vehicle documentation, business authorizations, and government approvals required for their activities.
This includes compliance with applicable rules governing scrap metal, solid waste, commercial waste, rubbish, demolition debris, recycling, vehicle operation, labor, environmental protection, dumping, storage, transportation, and disposal.
In New York City, certain commercial waste and rubbish-removal activities may require authorization from the New York City Business Integrity Commission or another government agency. A general picker or scrap account does not authorize a user to perform regulated waste hauling.
ScrapRunnerNYC may request documents or display badges, but users remain responsible for independently verifying whether another user is properly authorized for the specific work involved.
12. Safety
Scrap removal, lifting, loading, transportation, demolition, and waste handling can involve serious risk. Users are responsible for evaluating each location and activity before beginning work.
Users should:
- inspect the site and material before handling it;
- use appropriate protective equipment;
- avoid unsafe structures, energized equipment, unstable loads, and hazardous material;
- use properly rated vehicles, trailers, tools, and lifting equipment;
- comply with parking, traffic, loading, and property-access rules;
- avoid entering private property without permission;
- stop work if conditions are unsafe or materially different from the listing; and
- contact emergency services when immediate danger exists.
ScrapRunnerNYC does not provide safety supervision, job-site inspection, equipment inspection, environmental testing, or professional advice.
13. Text messages and communications
ScrapRunnerNYC may communicate with you by SMS, telephone, email, in-app message, or push notification regarding:
- login and verification codes;
- new listings and pickup opportunities;
- offers, claims, schedules, delays, arrivals, releases, and completions;
- account, credit, payment, safety, and policy information; and
- customer support and service announcements.
Message and data rates may apply. Delivery is not guaranteed and may be delayed or blocked by carriers, devices, network conditions, or user settings.
You are responsible for keeping your phone number current. You must not provide a phone number that you do not own or have authorization to use.
Where supported, you may opt out of non-essential text messages by following the instructions provided in the message. Certain operational messages may still be necessary to provide requested services.
14. Acceptable use and prohibited conduct
You may not:
- use ScrapRunnerNYC for fraud, theft, dumping, trespass, or other unlawful activity;
- post false, misleading, duplicate, bait-and-switch, or unauthorized listings;
- claim jobs you do not genuinely intend or are not equipped to complete;
- harass, threaten, discriminate against, intimidate, or abuse another user;
- impersonate another person, business, government agency, or ScrapRunnerNYC representative;
- misrepresent licenses, badges, insurance, experience, equipment, or identity;
- manipulate ratings, credits, referrals, offers, claims, or platform records;
- attempt to obtain credits without valid payment or authorization;
- use bots, scrapers, automated systems, or unauthorized software to access the Services;
- interfere with security, availability, or proper operation of the Services;
- upload malware or harmful code;
- collect or misuse another user’s personal information;
- circumvent restrictions, suspensions, verification requirements, or payment controls; or
- use the Services in a manner that creates unreasonable risk or liability.
15. User content
“User Content” includes photographs, descriptions, notes, addresses, locations, documents, ratings, messages, completion information, and other material submitted through ScrapRunnerNYC.
You retain ownership of your User Content. By submitting User Content, you grant ScrapRunnerNYC a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, reproduce, display, format, transmit, and use that content as reasonably necessary to operate, secure, improve, promote, and support the Services.
You represent that you own or have permission to submit the User Content and that its use by ScrapRunnerNYC will not violate another person’s rights or applicable law.
ScrapRunnerNYC may remove or restrict User Content but is not obligated to monitor all content before it appears.
16. Account restriction, suspension, and termination
ScrapRunnerNYC may investigate, restrict, suspend, or terminate an account or listing when it reasonably believes:
- these Terms or another policy has been violated;
- the account presents a safety, fraud, legal, payment, or reputational risk;
- required information or documents are false or invalid;
- a chargeback, payment dispute, or unauthorized transaction occurred;
- government, law-enforcement, court, or regulatory action requires it; or
- restriction is necessary to protect users, ScrapRunnerNYC, or third parties.
Suspension or termination may prevent access to listings, pickups, communications, credits, transaction history, or other account functions.
To the extent permitted by law, credits associated with fraud, abuse, chargebacks, policy violations, or prohibited conduct may be revoked without refund.
17. Disclaimers
ScrapRunnerNYC does not warrant that the Services will be uninterrupted, error-free, secure, accurate, or available at any particular time.
ScrapRunnerNYC does not warrant the identity, conduct, qualifications, licensing, insurance, equipment, reliability, or legal compliance of any user.
ScrapRunnerNYC does not warrant the ownership, quantity, composition, value, safety, recyclability, legality, or condition of any material.
18. Limitation of liability
To the maximum extent permitted by law, the total aggregate liability of ScrapRunnerNYC arising from or relating to the Services or these Terms will not exceed the greater of:
- the amount you paid directly to ScrapRunnerNYC during the six months before the event giving rise to the claim; or
- one hundred U.S. dollars.
Some jurisdictions do not allow certain limitations of liability, so some limitations may not apply to you.
19. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless ScrapRunnerNYC and its owners, officers, employees, contractors, affiliates, service providers, and agents from claims, damages, losses, liabilities, judgments, penalties, costs, and expenses, including reasonable attorneys’ fees, arising from or related to:
- your use of the Services;
- your listings, pickups, transportation, removal, recycling, or disposal activities;
- your User Content;
- your violation of these Terms or applicable law;
- your violation of another person’s rights;
- property damage, bodily injury, environmental harm, dumping, or contamination caused by you; or
- a dispute between you and another user or third party.
20. Governing law and disputes
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles.
Before filing a legal claim, you agree to contact ScrapRunnerNYC and attempt in good faith to resolve the dispute informally for at least thirty days.
Unless applicable law requires otherwise, any court proceeding arising from or relating to these Terms or the Services must be brought in a state or federal court located in New York, New York, and each party consents to the personal jurisdiction and venue of those courts.
Nothing in this section prevents either party from seeking emergency injunctive relief, reporting unlawful conduct, cooperating with government authorities, or bringing an eligible claim in small-claims court.
21. Copyright and intellectual property
ScrapRunnerNYC, its software, branding, logos, interface, design, databases, text, graphics, and other platform content are owned by ScrapRunnerNYC or its licensors and are protected by applicable intellectual-property laws.
These Terms grant you a limited, personal, revocable, non-exclusive, non-transferable right to use the Services for their intended purpose. They do not transfer ownership of any ScrapRunnerNYC intellectual property.
22. Third-party services
ScrapRunnerNYC may rely on or link to third-party services, including payment processors, mapping services, hosting providers, communication providers, cloud-storage providers, and external websites.
ScrapRunnerNYC is not responsible for the availability, accuracy, security, content, policies, or conduct of third-party services. Your use of those services may be governed by separate terms and policies.
23. Changes to the Services or these Terms
ScrapRunnerNYC may modify, add, suspend, or discontinue features, pricing, credit requirements, eligibility rules, or other parts of the Services.
ScrapRunnerNYC may update these Terms from time to time. The updated Terms will be posted with a revised effective date. When required, ScrapRunnerNYC may provide additional notice through the Services, by text message, or by email.
Continued use of the Services after updated Terms become effective constitutes acceptance of the updated Terms.
24. General provisions
These Terms and any policies incorporated by reference constitute the entire agreement between you and ScrapRunnerNYC regarding the Services.
If any provision is found unenforceable, the remaining provisions will remain in effect. Failure to enforce a provision is not a waiver.
You may not assign these Terms without ScrapRunnerNYC’s written consent. ScrapRunnerNYC may assign these Terms as part of a merger, financing, acquisition, restructuring, sale of assets, or transfer of the Services.
Headings are provided for convenience and do not limit the meaning of any provision.
